Terms of Service

1.1. Access to and use of the Platform and its Services is permitted only to individuals who are at least eighteen (18) years of age, are legally competent to enter into binding contracts under applicable Indian laws, and have not been previously suspended, restricted, or removed from using the Platform for any reason. By using the Platform, You represent and warrant that You meet all of these eligibility requirements.

1.2. If You are under the age of 18, You may access or use the Platform only under the supervision and with the express consent of a parent or legal guardian who agrees to be bound by these Terms on Your behalf. The Company reserves the right to request proof of age or consent at any time.

1.3. You further confirm that You are not a person who is prohibited or restricted from accessing or using the Platform under the laws of India or any other applicable jurisdiction, and that all information provided by You during registration or usage is truthful, accurate, and complete.

1.4. The Company may deny or revoke access to the Platform at its sole discretion if it has reason to believe that You do not meet the eligibility criteria or have violated any provisions of these Terms or applicable law. Any such suspension or termination shall not entitle You to any compensation, refund, or claim.

1.5. You agree not to engage in any activity that could harm the reputation, goodwill, or integrity of MyFellowPet, its affiliates, partners, or associated entities. This includes, but is not limited to, publishing or sharing false, misleading, defamatory, or malicious statements about MyFellowPet or its services, whether on the Platform or through any external channel. You also agree not to interfere with or place an unreasonable burden on the Platform’s infrastructure, systems, or security features, including through misuse, spamming, automated tools, or any attempt to disrupt the normal operation of the Platform or any services provided through it.

2.1. MyFellowPet is a digital platform that facilitates interactions between pet parents (“Users”) and independent third-party service providers offering pet-related services (“Service Providers”). These services are made available for discovery, comparison, communication, and booking through the Platform. MyFellowPet acts solely as an aggregator and facilitator and does not own, control, or directly provide any of the services listed on the Platform. MyFellowPet operates as a neutral intermediary and is not involved in the direct execution or delivery of services. All services are provided independently by Service Providers, who are not employees, agents, or representatives of the Company. Service Providers listed on the Platform determine their own service offerings, schedules, and terms, and operate autonomously. Users and Service Providers are solely responsible for the decisions they make, including service selection, booking, and communication. While MyFellowPet may provide tools, features, or in-app communication channels to enable smoother coordination, We do not certify, guarantee, or endorse any Service Provider or User. The presence of a Service Provider on the Platform does not constitute a recommendation or endorsement by the Company.

2.2. All bookings on the Platform are made digitally through the Platform interface. Users may use the integrated chat feature to communicate directly with Service Providers for clarification regarding availability, service details, or specific requirements. Once a User confirms a booking and completes payment through the Platform, the booking will be automatically processed and shared with the relevant Service Provider.

2.3. Payments for bookings are collected by MyFellowPet through a secure third-party payment gateway integrated within the Platform. MyFellowPet facilitates settlement to Service Providers within three (3) to five (5) business days following successful completion of the service, subject to applicable deductions, policies, or verifications. Users agree that payment made through the Platform constitutes valid and sufficient discharge of their payment obligations towards the Service Provider.

2.4. By using the Platform, You are granted a limited, non-exclusive, revocable, non-transferable right to access and use the Platform solely for personal, non-commercial purposes such as browsing, evaluating, and booking services. Any unauthorized or unlawful use, including commercial exploitation, resale, redistribution, or data scraping, is strictly prohibited.

2.5. The Company does not assume responsibility for the availability, quality, timing, safety, legality, or performance of services offered by Service Providers. All bookings facilitated through the Platform represent independent arrangements between You and the Service Provider. MyFellowPet shall not be liable for any act, omission, delay, or deficiency by any Service Provider, or for any loss or damage arising therefrom.

2.6. To access certain features or book services, You may be required to register and create an account (“Account”) by providing accurate and up-to-date information such as Your name, contact details, and pet information. You agree that all details submitted are true and current. MyFellowPet reserves the right to verify or validate such information at any time. Certain limited information (such as Your pet’s profile or contact number) may be shared with the Service Provider only for the purpose of facilitating bookings and only after You provide explicit consent.

2.7. MyFellowPet reserves the right to suspend, restrict, or permanently terminate access to the Platform if:

• You provide false, outdated, or misleading information;
• You violate any of these Terms or Platform Policies;
• You misuse or abuse any features of the Platform; or
• Your actions adversely affect the reputation, functioning, or integrity of MyFellowPet or any Service Provider.

Such suspension or termination shall not entitle You to any compensation, refund, or claim.

2.8. You agree not to impersonate any person or create more than one active Account. You may not assign, sell, rent, or transfer Your Account to any other person or entity.

2.9. The availability of services may vary depending on location, Service Provider capacity, and other operational factors. MyFellowPet and its Service Providers reserve the right to modify, limit, or discontinue any service, location, feature, or pricing at any time without prior notice. Users are advised to verify service details before booking.

2.10. The Platform may display or rank services based on relevance, proximity, popularity, pricing, or user preferences. Such listings may also be influenced by promotional arrangements or marketing partnerships. MyFellowPet does not guarantee equal visibility to all Service Providers and does not engage in discriminatory filtering unless required for legal compliance or safety reasons.

2.11. MyFellowPet shall not be responsible for any delays, cancellations, or unsatisfactory experiences resulting from third-party actions or unforeseen circumstances. However, Users are encouraged to report such issues promptly for appropriate investigation and resolution as per the Platform’s policies.

2.12. The Company may introduce additional features, verification processes, or eligibility requirements for Users or Service Providers at its discretion. MyFellowPet also reserves the right to restrict access to specific services, categories, or regions as necessary for operational, regulatory, or safety reasons.

3.1. MyFellowPet is a digital platform—comprising a mobile application and a website—designed to connect pet parents (“Users”) with independent pet service providers (“Service Providers”) offering a variety of pet-related services. The Platform enables Users to discover, compare, and book nearby services based on location, preference, and availability.

3.2. Our services are designed to simplify the process of finding trusted and verified Service Providers by aggregating listings and making them accessible in one convenient place. Users can browse available services, evaluate their options, communicate with Service Providers through the in-app chat feature, and complete bookings directly through the Platform.

3.3. The Platform serves solely as a facilitator that enables interactions and transactions between Users and independent Service Providers. It provides tools and features such as service listings, search filters, user ratings or reviews (where applicable), and booking and payment mechanisms. MyFellowPet does not itself offer or perform any pet care or related services.

3.4. MyFellowPet’s objective is to provide a reliable, centralized, and user-friendly experience for discovering and accessing pet services. All bookings and payments are processed digitally through the Platform, and payments are securely managed through an integrated third-party payment gateway.

3.5. Final booking confirmation occurs automatically once the User completes the booking process and payment on the Platform. Service fulfillment thereafter is the responsibility of the respective Service Provider. MyFellowPet’s role is limited to facilitating the transaction, processing payments, and ensuring that both parties can communicate and coordinate effectively through the Platform’s tools.

4.1. Compliance with Laws

You agree to use the Platform and all related services in strict compliance with all applicable local, state, national, and international laws, regulations, and policies. You shall not use the Platform for any unlawful, harmful, fraudulent, or unauthorized purpose, or in any manner that could impair, damage, disable, or overburden the Platform or interfere with any other User’s access or use.

4.2. Responsible Use

You are solely responsible for all activities conducted under Your Account and for any data, content, or information You submit, share, or display through the Platform. You agree not to misuse any functionality of the Platform, including communication or booking features, in a way that could disrupt, exploit, or negatively impact the experience of other Users or Service Providers.

4.3. Prohibited Activities

Without limiting the generality of the foregoing, You agree not to:

1. Post, upload, or transmit any content or material that is false, misleading, defamatory, obscene, harassing, abusive, discriminatory, offensive, or otherwise unlawful;
2. Harass, threaten, intimidate, or abuse any User, Service Provider, or Company representative;
3. Infringe, violate, or misappropriate the intellectual property, confidentiality, or privacy rights of any person or entity;
4. Attempt to gain unauthorized access to any portion of the Platform, User accounts, computer systems, or networks connected to the Platform;
5. Use any automated scripts, bots, crawlers, or data mining tools to access, scrape, or collect information from the Platform without prior written authorization from the Company;
6. Interfere with, disrupt, or compromise the security, performance, or functionality of the Platform or its supporting infrastructure; or
7. Use the Platform to promote, solicit, or engage in any commercial activity not expressly permitted by the Company.

4.4. User Accountability

You acknowledge and agree that You are solely responsible for Your conduct, communications, and interactions on or through the Platform. MyFellowPet shall not be held liable for any dispute, injury, loss, or damage arising from Your interactions or transactions with other Users or Service Providers, whether conducted online or offline. Users are advised to exercise caution and good judgment in all communications and transactions.

4.5. Enforcement and Remedies

The Company reserves the right, at its sole discretion, to investigate any violation or suspected violation of these Terms and to take any action it deems appropriate. Such actions may include, but are not limited to, suspension or termination of Your Account, restriction of access to the Platform, removal of offending content, or reporting of unlawful activity to relevant authorities. In the event of any breach, You may also be held liable for any losses, damages, or expenses incurred by the Company or any third party as a result of such violation.

5.1. You are solely responsible for the accuracy and completeness of all information You provide while registering and maintaining Your Account on the MyFellowPet Platform. You agree to ensure that all such information is accurate, current, and up to date at all times. In the event of any change to Your personal details or contact information, You must promptly update the same through the Platform.

5.2. If any information provided by You is found to be false, misleading, outdated, incomplete, or otherwise inaccurate, or if the Company has reasonable grounds to suspect such inaccuracy, We reserve the right to suspend or terminate Your access to the Platform, restrict Account functionality, or refuse current or future use of the services, with or without prior notice.

5.3. You are solely responsible for maintaining the confidentiality of Your Account credentials, including Your username, password, and any other authentication details associated with Your Account. You acknowledge and agree that any activity or transaction carried out through Your Account shall be deemed to have been authorized by You, and You will be solely liable for all such actions, whether undertaken by You or by any third party using Your credentials.

5.4. MyFellowPet shall not be liable for any unauthorized access, loss, damage, or activity resulting from Your failure to maintain the confidentiality of Your Account credentials. If You become aware of or suspect any unauthorized use of Your Account, compromise of Your login information, or any breach of security, You must notify the Company immediately at the contact details provided on the Platform.

5.5. Upon receiving such notification, MyFellowPet may, at its sole discretion, take reasonable steps to secure Your Account, including temporary suspension, password reset, or other necessary actions to protect the integrity of the Platform and its Users. The Company shall not be responsible for any delay or consequence arising from Your failure to report such incidents promptly.

6.1. Booking Process

All bookings on the Platform are made digitally and confirmed automatically once the User completes the booking process and payment through the Platform. Users may communicate directly with Service Providers via the in-app chat feature to clarify details such as availability, timing, or service requirements before booking. MyFellowPet does not manually coordinate, pre-approve, or auto-charge Users without their explicit action and confirmation through the Platform. Bookings and payments are processed only upon the User’s initiation.

6.2. Fees and Charges

All fees and charges applicable to services listed on the Platform are determined solely by the respective Service Providers and displayed transparently at the time of booking. MyFellowPet does not control, modify, or influence the pricing of any service and shall not be liable for any discrepancies in pricing or availability.

6.3. Payment Methods

Payments for bookings are processed exclusively through third-party payment gateways integrated into the Platform. The accepted payment methods (including credit/debit cards, UPI, or wallets) will be displayed during checkout. All transactions are processed in Indian Rupees (INR), unless otherwise specified.

6.4. Authorization and Responsibility

By providing Your payment information (“Payment Details”), You represent and warrant that:

1. You are legally authorized to use the payment method provided;
2. You have sufficient funds or credit to complete the transaction; and
3. The use of such Payment Details complies with all applicable laws and third-party terms.

MyFellowPet does not store or directly process any Payment Details. Your use of any third-party payment service is governed by the respective provider’s terms and privacy policy. MyFellowPet shall not be liable for any errors, failures, or disputes arising from such services.

6.5. Service Provider Rights and Pet Mismatch Policy

If, upon arrival or service initiation, the Service Provider finds that the pet’s details (including species, breed, size, behavior, health condition, or any disclosed information) materially differ from the details provided during booking, the Service Provider reserves the right to refuse or cancel the service without any obligation for refund. Such rejections are permitted in order to maintain safety, service integrity, and fairness. Users are therefore required to provide accurate and complete pet details during booking. MyFellowPet shall not be held liable for any loss or inconvenience arising from such rejections.

6.6. Transaction Failures and Limitations of Liability

Except as required by applicable law, MyFellowPet shall not be responsible for failed or incomplete payment transactions, including but not limited to those resulting from:

• Insufficient funds or credit;
• Incorrect or outdated Payment Details;
• Technical issues affecting the Platform or payment gateway;
• Unauthorized or fraudulent activity;
• Violation of payment provider terms;
• Expired or blocked cards or accounts; or
• Circumstances beyond Our reasonable control.

6.7. No Refund Obligation for Unauthorized Transactions

MyFellowPet is not obligated to provide any refund for unauthorized, fraudulent, or disputed transactions made using Your Payment Details. You are solely responsible for ensuring the security and accuracy of Your payment information.

6.8. Payment Settlement

MyFellowPet facilitates payments between Users and Service Providers through an authorized third-party gateway. Service Providers are paid their respective dues within three (3) to five (5) business days following successful service completion, subject to applicable deductions, settlement policies, or verification processes.

6.9. Support and Inquiries

For payment-related issues, please contact our support team at support@myfellowpet.com. While we may coordinate communication with the Service Provider or payment gateway, MyFellowPet does not guarantee the resolution of payment disputes beyond what is required under applicable law or policy.

6.10. Beware of Fraud

MyFellowPet and its authorized representatives will never ask You to share sensitive financial details such as:

• Debit/Credit Card Numbers
• CVV or UPI PINs
• OTPs (One-Time Passwords)
• Net Banking Credentials

Do not share such details with anyone claiming to represent MyFellowPet. If You suspect fraudulent activity or receive suspicious communications, immediately report the incident to Your bank, local authorities, and the official government cybercrime portal at https://cybercrime.gov.in, and notify us at support@myfellowpet.com.

7.1. Cancellations and Refunds

All cancellations and refund requests are governed by MyFellowPet’s Cancellation and Refund Policy, which forms an integral part of these Terms, along with the individual refund and cancellation rules set by each Service Provider. Each Service Provider specifies their own refund conditions including timelines, deduction percentages, and eligibility (for example, cancellations made before 24 hours, 12 hours, or 4 hours of the booking start time). These terms are displayed to the User at the time of booking and are binding once the booking is confirmed. Refunds will be processed strictly in accordance with:

1. the specific refund terms defined by the respective Service Provider, and
2. the Company’s Cancellation and Refund Policy framework.

No refund shall be issued for cancellations made after service commencement, or where a Service Provider refuses service due to incorrect, incomplete, or misleading pet details (including species, breed, temperament, or health conditions). Refund timelines may vary depending on the User’s payment method and the processing timelines of the third-party payment gateway or banking partners.

7.2. Disputes with Service Providers

Any dispute or complaint related to the performance, timing, quality, or outcome of a service shall be raised directly with the concerned Service Provider through the Platform’s chat or support feature. While MyFellowPet may, at its discretion, assist by providing communication channels or limited mediation support, such facilitation does not imply that MyFellowPet assumes any responsibility for the Service Provider’s performance, commitments, or refund decisions. MyFellowPet is a neutral facilitator and not a party to the service contract between Users and Service Providers.

7.3. Resolution and Remedies

In case of a dispute regarding cancellation, refund amount, or service non-performance, the final refund or compensation amount (if any) shall be determined based on:

1. the applicable Service Provider refund policy,
2. the MyFellowPet Cancellation and Refund Policy, and
3. any relevant evidence or communication submitted by both parties.

MyFellowPet’s decision, made in good faith and in accordance with the above, shall be final and binding to the extent permitted by law.

7.4. Reporting and Support

For any refund-related queries or disputes, Users may contact support@myfellowpet.com. MyFellowPet may request additional documentation such as payment receipts, screenshots, or chat records to facilitate resolution. Users are expected to cooperate in good faith throughout the resolution process.

8.1. You acknowledge and agree that all rights, titles, and interests in and to the MyFellowPet Platform including but not limited to its software, source code, user interface, design, layout, features, functionality, graphics, text, images, audio, video, and the overall “look and feel” are and shall remain the exclusive property of Scentemote Technologies Private Limited (operating under the brand name “MyFellowPet”) and/or its licensors. All such materials are protected under applicable intellectual property laws of India and international conventions.

8.2. All trademarks, service marks, trade names, brand names, and logos used or displayed on the Platform (collectively, the “Marks”) are the sole and exclusive property of MyFellowPet or their respective owners. Nothing contained on the Platform shall be construed as granting, by implication or otherwise, any license, right, or permission to use any Mark without the prior written consent of MyFellowPet or the applicable third-party owner.

8.3. Except as expressly permitted under these Terms, You shall not duplicate, copy, modify, publish, adapt, translate, transmit, distribute, reverse engineer, decompile, disassemble, or create derivative works from any portion of the Platform or its content, in whole or in part, without the Company’s prior written authorization. Any unauthorized use may result in civil or criminal liability under applicable laws.

8.4. You agree not to make or disseminate any false, misleading, or disparaging statements (verbal, written, or online) regarding MyFellowPet, its Platform, brand, products, services, employees, affiliates, or partners, that could damage its reputation, goodwill, or business interests.

8.5. Any feedback, ideas, suggestions, improvements, or concepts that You voluntarily submit to MyFellowPet relating to the Platform or its operations (“Feedback”) may be used, adapted, implemented, or commercialized by the Company at its sole discretion, without any obligation to compensate, credit, or acknowledge You. You hereby waive any rights, claims, or ownership interests in such Feedback once submitted.

8.6. All content uploaded or shared by Users or Service Providers on the Platform (including text, images, descriptions, or media files) remains the intellectual property of the respective owner. However, by posting or sharing such content, You grant MyFellowPet a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, display, and distribute such content for the limited purpose of operating, promoting, and improving the Platform and its services.

9.1. Content Ownership

All content available on or through the Platform including but not limited to text, graphics, images, illustrations, icons, software, code, databases, compilations, audio-visual materials, and documentation is the intellectual property of Scentemote Technologies Private Limited (operating under the brand name “MyFellowPet”) or its licensors. Such content is protected under applicable copyright, trademark, trade secret, and other intellectual property laws of India and international treaties. Nothing in these Terms shall be construed as transferring or assigning any ownership rights to You. All rights not expressly granted are reserved by MyFellowPet and/or its licensors.

9.2. Use Restrictions

You agree not to copy, reproduce, modify, distribute, transmit, display, publish, sell, lease, create derivative works from, or otherwise exploit any part of the Platform or its content, in whole or in part, for any commercial, public, or unlawful purpose without the prior written authorization of the Company. Any unauthorized use of the Platform or its content may result in suspension of access and/or legal proceedings under applicable laws.

9.3. User-Generated Content

If You upload, post, share, or otherwise make available any material, including but not limited to reviews, feedback, photographs, videos, or suggestions (“User Content”), You grant MyFellowPet a worldwide, royalty-free, non-exclusive, perpetual, irrevocable, and transferable license to use, reproduce, display, publish, modify, adapt, and distribute such content in connection with the operation, improvement, and marketing of the Platform. You represent and warrant that You own or have all necessary rights, licenses, and permissions to submit such content and that Your User Content does not infringe upon or violate the rights of any third party. MyFellowPet reserves the right, but not the obligation, to monitor, review, or remove any User Content that it deems inappropriate, offensive, or in violation of these Terms or applicable law.

9.4. Copyright Infringement – Takedown Procedure

MyFellowPet respects the intellectual property rights of others and expects Users and Service Providers to do the same. If You believe that any content on the Platform infringes Your copyright or the rights of someone You represent, You may submit a written complaint to support@myfellowpet.com with the following details:

• Your full name, address, phone number, and email address;
• A description of the copyrighted work claimed to be infringed;
• Clear identification of the infringing material and its exact location (URL or screenshot, if available);
• A statement confirming that You have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law;
• A declaration under penalty of perjury that the information provided is accurate and that You are authorized to act on behalf of the copyright owner; and
• Your physical or electronic signature.

Upon receipt of a valid notice, MyFellowPet will investigate the claim, remove or disable access to the allegedly infringing content (if warranted), and may notify the concerned User or Service Provider.

9.5. Repeat Infringers

MyFellowPet reserves the right to suspend or permanently terminate the accounts of Users or Service Providers who are found to repeatedly infringe upon the intellectual property rights of others, fail to comply with takedown requests, or violate applicable laws, subject to due consideration of the facts and applicable legal provisions.

10.1. Data Collection

When You use the MyFellowPet Platform, We may collect, store, and process certain personal data, including but not limited to Your name, contact information, location data, booking history, pet details, and any other information voluntarily provided by You. This information is collected for purposes such as enabling account creation, improving Platform functionality, processing payments, facilitating transactions between Users and Service Providers, and ensuring compliance with applicable legal and operational requirements.

10.2. Use of Data

The personal and transactional information collected may be used for one or more of the following purposes:

• To provide, operate, and improve Platform functionality and user experience;
• To communicate with You regarding Your bookings, transactions, or account activity;
• To personalize recommendations, listings, and content based on Your preferences or location;
• To ensure compliance with these Terms, Platform Policies, and applicable laws;
• To conduct internal analysis, research, and business intelligence;
• To detect, prevent, and address technical or security issues.

10.3. Data Sharing

Your personal information may be shared strictly on a need-to-know basis with:

• Service Providers, only to the extent necessary to fulfill confirmed bookings, communicate regarding services, or manage related transactions;
• Third-party partners, such as payment gateways, hosting services, analytics providers, or communication tools, solely for purposes of operating and maintaining the Platform;
• Government authorities, law enforcement agencies, or regulatory bodies, when required by applicable law, court order, or to protect the rights, safety, and property of the Company, Users, or the public.

MyFellowPet does not sell, rent, or trade Your personal data to any third party for marketing or commercial gain.

10.4. Data Security

We implement reasonable technical and organizational security measures to safeguard Your personal information against unauthorized access, alteration, misuse, or disclosure. These measures include encryption, limited access controls, and secure storage protocols. However, You acknowledge and understand that no system or transmission method over the internet is completely secure. MyFellowPet cannot guarantee absolute data security, and You agree that You share information at Your own discretion and risk.

10.5. Retention of Data

We retain Your personal data only for as long as necessary to fulfill the purposes outlined in this clause or as required by applicable law. Once such purposes are met, Your data will be deleted, anonymized, or securely archived in accordance with Our internal data retention policy and legal obligations.

10.6. User Rights

Subject to applicable data protection laws, You may have the right to:

• Access and review the personal information held by Us;
• Request corrections or updates to inaccurate or incomplete information;
• Request deletion of Your personal data, subject to Our legal or operational requirements;
• Withdraw consent for data processing (where applicable), understanding that such withdrawal may affect service functionality.

To exercise these rights, You may contact Us at support@myfellowpet.com, and We will process such requests in accordance with applicable laws and verification procedures.

10.7. Consent and Updates

By accessing or using the Platform, You expressly consent to the collection, use, storage, and disclosure of Your information as described herein and in the Privacy Policy. MyFellowPet reserves the right to revise, modify, or update its privacy practices at any time to reflect operational, legal, or technological changes. Significant updates will be communicated by amending this clause and/or by direct notice through the Platform.

10.8. Separate Privacy Policy

Additional details regarding how Your personal data is collected, processed, retained, and protected are outlined in the MyFellowPet Privacy Policy, which forms an integral part of these Terms. Users are strongly encouraged to review the Privacy Policy carefully to understand their rights and the Company’s obligations under applicable law.

11.1. Third-Party Advertisements

The Platform may display advertisements, sponsored listings, affiliate promotions, or other marketing content from third-party advertisers, brands, or partners (“Third-Party Advertisers”). MyFellowPet does not endorse, verify, control, or guarantee the accuracy, quality, legality, or reliability of any information, product, or service offered by such Third-Party Advertisers. Any interaction, transaction, or correspondence between You and such advertisers including purchases or participation in promotional activities shall be solely between You and the respective advertiser. MyFellowPet disclaims all liability arising from or related to Your dealings with Third-Party Advertisers, and You agree that the Company shall not be responsible for any loss, damage, or dissatisfaction resulting from such interactions.

11.2. Sponsored Content and Transparency

Certain listings or promotional placements on the Platform may be marked as “Sponsored,” “Promoted,” or “Featured.” Such content may be the result of paid arrangements or partnerships. MyFellowPet ensures that all such sponsored or promotional content is clearly labeled in accordance with applicable advertising and consumer protection laws in India. MyFellowPet does not guarantee the performance, outcomes, or reliability of any service or product advertised or promoted on the Platform.

11.3. Advertiser Obligations

If You are a Third-Party Advertiser or partner, You agree to comply with all applicable advertising laws, rules, and self-regulatory codes including those issued by the Advertising Standards Council of India (ASCI) and any other competent authority. You further agree that Your advertisements shall not be false, deceptive, obscene, discriminatory, or otherwise unlawful. MyFellowPet reserves the right to review, approve, modify, or remove any advertisement at its sole discretion, without prior notice, particularly if such content is found to be misleading, inappropriate, or in violation of law or Platform policies.

11.4. Reporting Concerns

If You believe that any advertisement, promotion, or sponsored content on the Platform is misleading, offensive, fraudulent, or non-compliant with applicable laws or guidelines, You may report it to support@myfellowpet.com. MyFellowPet will review the reported content and take appropriate action, including removal or referral to the concerned advertiser or authority, as deemed necessary.

12.1. Right to Modify or Discontinue Services

MyFellowPet reserves the right, at its sole discretion, to add, modify, suspend, or discontinue any part of the Platform, including its features, services, or offerings, at any time without prior notice. The Company shall not be liable for any modification, suspension, or discontinuation of the Platform or any portion thereof.

12.2. Platform Monitoring and Access Controls

MyFellowPet reserves the right to monitor and review Platform activity to ensure compliance with these Terms and to protect the integrity of its systems, Users, and Service Providers. The Company may restrict, suspend, or terminate access to any User or Service Provider found to be violating these Terms, engaging in fraudulent or abusive activity, or misusing the Platform in any manner.

12.3. No Guarantee of Access or Availability

While the Company endeavors to maintain continuous and uninterrupted access to the Platform, it does not guarantee that the Platform will always be available, functional, secure, or error-free. Access may be temporarily suspended or restricted due to maintenance, upgrades, network failures, or other technical issues beyond the Company’s control. MyFellowPet shall not be responsible for any loss or inconvenience resulting from such interruptions.

12.4. Platform Content and Listings

All content, service listings, and arrangements displayed on the Platform are subject to modification, reorganization, or removal at the Company’s discretion. MyFellowPet may filter, prioritize, or rank listings based on relevance, location, user activity, quality ratings, or promotional factors. The Company is not obligated to display all listings, Service Providers, or Users equally or to guarantee specific visibility to any party.

12.5. Limitation on Automated Use

Users shall not use any automated tools such as robots, spiders, scrapers, or other data-extraction mechanisms to access, copy, or interact with the Platform or its data for any purpose without prior written consent from the Company. Unauthorized use of automated means may result in immediate suspension or permanent termination of access, and may constitute a violation of applicable law.

12.6. Limitation of Liability for Platform Use

To the maximum extent permitted under applicable law, MyFellowPet, its affiliates, directors, employees, and licensors shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising out of or related to:

1. Your access to or inability to access the Platform,
2. Use or misuse of any content, feature, or service on the Platform,
3. Service interruptions, technical failures, or system errors,
4. Data loss, unauthorized access, or third-party actions, or
5. Any other matter related to Platform use.

Your sole and exclusive remedy for any dissatisfaction with the Platform or its services is to discontinue use of the Platform.

12.7. Abuse Reporting and Action

Users who encounter any misuse of the Platform, including but not limited to fraudulent listings, abusive behavior, false representations, or prohibited content, may report the issue to support@myfellowpet.com. MyFellowPet reserves the right to investigate and take appropriate action, including suspension or permanent removal of access, based on the severity and nature of the violation.

13.1. Platform Provided “As Is”

The Platform and all its features, content, and services are provided on an “as is” and “as available” basis, without any representations, warranties, or conditions of any kind, whether express, implied, or statutory. MyFellowPet disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability. MyFellowPet makes no representation or warranty that the Platform, its content, or services will meet Your expectations, be error-free, secure, or uninterrupted.

13.2. No Guarantee of Services or Outcomes

While MyFellowPet conducts limited preliminary checks on Service Providers at the time of registration to verify their basic legitimacy, the Company does not guarantee or warrant the quality, reliability, safety, suitability, legality, or performance of any services offered by them. Beyond initial verification, MyFellowPet does not undertake continuous monitoring, supervision, or validation of Service Providers or their ongoing conduct. Any reliance placed by You on the information, profiles, or listings available on the Platform shall be at Your sole risk and discretion.

13.3. Third-Party Interactions

Your interactions, communications, and transactions with Service Providers or other Users, whether online or offline, are conducted entirely at Your own discretion and risk. MyFellowPet is not a party to any contract or agreement formed between You and any Service Provider, and the Company shall not be liable for any loss, injury, damage, cost, or dissatisfaction resulting from such interactions or from the services rendered by third parties.

13.4. No Professional or Veterinary Advice

Any information, content, or resources made available on the Platform are intended solely for general informational purposes. They do not constitute professional, medical, or veterinary advice, and should not be relied upon as a substitute for consultation with qualified professionals. MyFellowPet shall not be responsible for any decisions, actions, or outcomes based on information obtained from the Platform.

13.5. Limitation of Liability

To the fullest extent permitted by applicable law, MyFellowPet, its affiliates, officers, directors, employees, agents, representatives, and licensors shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from or related to:

1. Your access to, use of, or inability to access or use the Platform;
2. The conduct, actions, or omissions of any Service Provider, User, or third party on the Platform;
3. Any service booked, rendered, or canceled through the Platform, whether or not the Company was advised of the possibility of such damages;
4. Errors, interruptions, system failures, or data breaches;
5. Unauthorized access to, or alteration, use, or disclosure of, Your account, data, or communications.

In no event shall the total aggregate liability of MyFellowPet for all claims arising out of or related to the use of the Platform exceed the total amount paid by You for the specific transaction giving rise to such claim, if any.

13.6. Applicable Law

The limitations and exclusions set forth in this Section apply to the maximum extent permitted under applicable Indian law. Certain jurisdictions may not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, in which case some of the above limitations may not apply to You.

14.1. Termination by User

You may request deletion of Your account at any time through the Platform or by contacting the support team at support@myfellowpet.com. Upon receiving such a request, Your account will be deactivated and scheduled for permanent deletion after thirty (30) days. During this period, You may choose to reactivate Your account by logging in. After thirty (30) days, Your account and associated data will be permanently deleted and cannot be recovered, except where retention is required by law, for dispute resolution, or for legitimate business purposes as specified in the Privacy Policy.

14.2. Termination or Suspension by MyFellowPet

MyFellowPet reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate Your account or access to the Platform, in whole or in part, without prior notice, under any of the following circumstances:

• You breach or violate these Terms, any Platform Policies, or applicable laws;
• You engage in fraud, abuse, or misuse of the Platform or its services;
• Unauthorized, suspicious, or harmful activity is detected from Your account;
• Your actions or content pose a threat to the safety, reputation, or operation of the Platform, Users, or Service Providers;
• Termination or suspension is required by a law enforcement agency, court order, or regulatory authority; or
• The Company determines, in its sole judgment, that continued access may expose it to legal or operational risk.

MyFellowPet may, but is not obligated to, provide notice of such suspension or termination after the action has been taken.

14.3. Effect of Termination

Upon termination or deactivation of Your account:

1. All licenses, permissions, and rights granted to You under these Terms shall immediately cease;
2. Access to Your account, booking history, messages, and saved data shall be revoked;
3. All active or future bookings shall be canceled, unless otherwise provided under applicable refund or cancellation policies;
4. The Company may retain or archive certain transaction data or communication records as required under applicable law or internal compliance requirements;
5. You remain responsible for any outstanding payments, obligations, or liabilities incurred prior to termination.

14.4. Survival of Terms

Provisions of these Terms that by their nature are intended to survive termination shall continue to remain in full force and effect. These include, but are not limited to, provisions relating to intellectual property, confidentiality, payment obligations, indemnification, disclaimers, limitation of liability, governing law, and dispute resolution.

These Terms, along with all policies, guidelines, and related documents incorporated herein, shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

You agree that the courts located in Bengaluru, Karnataka, India, shall have exclusive jurisdiction over any dispute, claim, or proceeding arising out of or in connection with the use of the Platform, these Terms, or any related agreement, including questions concerning their existence, validity, or termination.

You expressly consent to the personal and exclusive jurisdiction of such courts and waive any objections based on venue, jurisdiction, or inconvenient forum.

16.1. Right to Modify

MyFellowPet reserves the right, at its sole discretion, to amend, modify, update, or replace these Terms of Use, in whole or in part, at any time. Any such revisions shall become effective upon publication on the Platform, unless otherwise stated.

16.2. Notification of Changes

MyFellowPet may, at its discretion, provide notice of material changes to these Terms through email, in-app notification, or by displaying a notice on the Platform. However, the Company is under no obligation to provide individual or advance notice of every update. It remains Your responsibility to review these Terms periodically to stay informed of the latest version.

16.3. Continued Use Deemed Acceptance

Your continued access to or use of the Platform following the posting of updated Terms shall constitute Your acceptance of those revisions. If You do not agree to the modified Terms, You must immediately discontinue all use of the Platform and associated services.

The aforementioned details of the Grievance cum Nodal Officer are provided in compliance with (1) the Information Technology Act, 2000 and rules made thereunder, and (2) the Consumer Protection (E-Commerce) Rules, 2020, as amended from time to time. The Grievance Officer will acknowledge receipt of complaints within 48 hours and endeavor to resolve them within 15 days of receipt, in accordance with applicable laws.

18.1. Consent to Communications

By registering on or using the MyFellowPet Platform, You expressly consent to receive communications from the Company, including but not limited to SMS, email, phone calls, WhatsApp messages, and push notifications. Such communications may relate to bookings, account activity, service updates, policy changes, or promotional offers. These communications may be sent by MyFellowPet directly or through its authorized service partners and communication platforms.

18.2. Opt-Out Option

You may opt out of receiving promotional or marketing messages at any time by following the unsubscribe instructions provided in such communications or by adjusting Your preferences in the Platform settings. However, You will continue to receive essential transactional and service-related communications, including but not limited to booking confirmations, password resets, payment alerts, and legal notifications, which are necessary for the operation of Your account and services.

18.3. Override of DND or NDNC Registration

By providing Your contact information, You authorize MyFellowPet and its representatives to contact You through voice calls, SMS, WhatsApp, or email, even if Your contact number is registered under the Do Not Disturb (DND), National Customer Preference Register (NCPR), or any equivalent registry. This authorization is limited to communications directly related to the services offered by MyFellowPet and does not extend to unrelated marketing activities.

19.1. Notice

MyFellowPet may send important notices or communications to You via email, SMS, WhatsApp, or through notifications on the Platform. It is Your responsibility to ensure that the contact information linked to Your account remains current and accurate.

19.2. Assignment

You are not permitted to transfer or assign any of Your rights or obligations under these Terms without prior written approval from MyFellowPet. We may transfer or delegate our rights and responsibilities under these Terms to our affiliates, successors, or any third party without needing to notify You.

19.3. Force Majeure

MyFellowPet will not be responsible for delays or failures in fulfilling its obligations due to events beyond its reasonable control. These events may include but are not limited to acts of God, natural disasters, internet outages, technical failures, war, terrorism, labor disputes, government actions, or other force majeure events.
